General Terms and Conditions (GTC)

1. Scope
These General Terms and Conditions (GTC) apply to all orders placed through the online shop of Herman Onlinehandel at herman-onlinehandel.ch.
The online shop is intended exclusively for customers with a delivery address in Switzerland or the Principality of Liechtenstein. Deliveries to other countries are currently not offered.

3. Product range and age restriction
Herman Onlinehandel sells selected accessory products for adult smokers, in particular cigarette filling machines and cigarette cases.
We do not sell tobacco, cigarettes, cigarette tubes, e-cigarettes or nicotine products.
Orders through our online shop are permitted only for persons of legal age, aged 18 or over. By submitting an order, you confirm that you are at least 18 years old.
We reserve the right to refuse or cancel orders if there are justified doubts regarding the customer’s legal age.
4. Products and product information
We make every effort to present all product information, images, descriptions, prices and availability correctly and up to date.
Minor deviations in colour, packaging, presentation or design are possible, provided that they do not affect the essential product characteristics. Product images may differ from the actual product depending on screen display, lighting conditions or packaging batch.
The ZORR cigarette filling machines offered are original ZORR goods from a reputable source.
5. Offer and conclusion of contract
The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding invitation to place an order.
You can place the desired products in the shopping cart and review and correct your entries before submitting the order.
By clicking the final order button, you place a binding order.
After receipt of your order, you will receive an automatic order confirmation by email. This confirmation documents that your order has been received by us.
The purchase contract is concluded as soon as we expressly accept your order, confirm shipment or dispatch the goods.
6. Prices and shipping costs
All prices are stated in Swiss francs (CHF) and include statutory value added tax.
Shipping costs are not included in the product price and are shown separately in the checkout.
The price displayed in the online shop at the time of the order is decisive.

7. Payment
The payment methods shown in the checkout are available.
Payment is processed through the respectively connected payment service providers. We reserve the right not to offer individual payment methods in individual cases.
An order is usually processed only after successful payment confirmation or receipt of payment.
8. Delivery
We deliver exclusively to addresses in Switzerland and the Principality of Liechtenstein.
Delivery is made to the delivery address provided by you in the checkout. Please ensure that your delivery address is complete and correct.

9. Retention of title
The goods remain the property of Herman Onlinehandel until full payment has been received.
10. Returns, withdrawal and complaints
In Switzerland, there is generally no statutory general right of withdrawal for online purchases unless such a right has been expressly agreed.
Herman Onlinehandel grants a voluntary right of return of 14 days from receipt of the goods for unused, undamaged, complete and originally packaged items in accordance with our Returns and Complaints Policy.
Our separately published Returns and Complaints Policy applies to returns, complaints, defects, transport damage and incorrect deliveries.
Your statutory rights in the case of defective goods remain unaffected.
11. Use of the products
The products offered must be used as intended and in accordance with the respective product instructions.
Herman Onlinehandel is not liable for damage caused by improper use, misuse or unauthorised modification of the products.
12. Use of the online shop and copyright
The contents of this online shop, in particular texts, images, graphics, logos and layouts, are protected by copyright.
Any use beyond the limits permitted by law requires our prior written consent.
13. Data protection
The processing of personal data is governed by our Privacy Policy in its current version.
14. Liability
We are liable for damage caused by intentional or grossly negligent conduct, as well as within the scope of mandatory statutory provisions.
Otherwise, liability is excluded to the extent permitted by law.
15. Changes to the GTC
We may amend these GTC at any time.
The version published on this website at the time of the order is decisive.
16. Applicable law and place of jurisdiction
Swiss law applies, excluding conflict-of-law rules.
For disputes arising from consumer contracts, the mandatory statutory places of jurisdiction apply.
Where no mandatory place of jurisdiction exists, the registered office of Herman Onlinehandel shall be the place of jurisdiction.
17. Final provisions
Should any provision of these GTC be invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.
